Our Commitment to Your Privacy

At New Growth Counseling, LLC, we understand that your health information is personal. We are committed to protecting the privacy of your medical records in strict accordance with the Health Insurance Portability and Accountability Act (HIPAA) and the heightened protections required by 42 CFR Part 2 for Substance Use Disorder (SUD) records.

Heightened Protections for Substance Use Disorder Records

In accordance with the 2026 HIPAA/42 CFR Part 2 Final Rule, records created, kept, or used by our Intensive Outpatient Program (IOP) and other SUD services receive special protection.

  • Written Consent Required: We will not disclose any information identifying you as a patient in our SUD programs without your express written consent, except in specifically permitted cases such as a medical emergency or a court order that meets the strict requirements of 42 CFR Part 2.

  • Restricted Use in Legal Proceedings: Your SUD records cannot be used to criminally investigate or prosecute you without a specific court order that meets the criteria of federal law.

How We Use and Disclose Your Information

We use your information for the following primary purposes:

  1. Treatment: To provide, coordinate, or manage your healthcare and related services.

  2. Payment: To verify your insurance coverage, process claims, and obtain payment for services provided to you.

  3. Healthcare Operations: To support the business activities of our practice, such as quality assessment, employee review, and licensing.

Google Advertising & Digital Data Collection

We utilize Google Ads to help individuals in New Mexico find recovery services.

  • No Retargeting: In compliance with Google’s Healthcare & Medicines policy, we do not use “remarketing” or “personalized advertising” that identifies or follows you based on your health status.

  • Voluntary Submission: Information submitted through our online “Verify Insurance” or “Contact” forms is voluntary and encrypted for your protection.

Your Rights Regarding Your Health Information

  • Access: You have the right to inspect and receive a copy of your medical and billing records.

  • Accounting of Disclosures: You have the right to request a list of certain disclosures we have made of your health information.

  • Amendments: If you feel the information we have is incorrect, you may ask us to amend it.

  • Restriction Requests: You have the right to request a restriction on how we use or disclose your health information.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our Privacy Officer or with the Secretary of the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
